A shocking revelation has emerged, highlighting the dire state of environmental protection in the United States. An in-depth analysis of Environmental Protection Agency (EPA) records reveals a near-complete halt in enforcing laws against major polluters, a trend that has persisted under the Trump administration.
The report, conducted by the non-profit Public Employees for Environmental Responsibility (Peer), paints a grim picture. It shows a dramatic decline in the number of consent decrees, which are the legal tools used to enforce environmental laws. For instance, the EPA filed only one Clean Air Act consent decree in a year, compared to 26 during Trump's first term and 22 during Biden's first year. Similarly, enforcement of Superfund laws, crucial for cleaning up highly polluted sites, has slowed, with just seven consent decrees filed, down from 31 under the first Trump administration.
But here's where it gets controversial... The EPA's enforcement program appears to be intentionally dying, according to Tim Whitehouse, Peer's executive director and a former EPA attorney. He argues that without adequate enforcement, the laws become voluntary, and companies may choose to ignore them, leading to more pollution and profits for polluters.
The analysis focused on major cases, typically involving large corporations like Volkswagen and BP, which have faced significant penalties in the past. However, industry observers note that such blockbuster settlements are now rare.
An EPA spokesperson defended the administration's record, stating their focus is on swift compliance rather than overzealous enforcement. They criticized the report as an erroneous claim funded by dark money.
However, a current EPA enforcement employee, speaking anonymously, highlighted the difference between compliance and enforcement. They explained that the administration's emphasis on compliance, which often involves mild suggestions and minimal consequences, is not an effective deterrent.
The employee also pointed to political appointees at the EPA who scrutinize investigators' work, causing a review backlog and delaying cases. Additionally, staffing cuts in the enforcement division and the justice department's environmental division have contributed to a broad chilling effect on enforcement actions.
This situation poses a significant risk to public health and empowers companies to pollute with impunity, knowing the EPA and DoJ are unlikely to take strong action against them.
The Peer report also addressed the EPA's claim that it handles minor cases as civil administrative matters, stating that while this approach is suitable for quick resolutions, it is not effective for complex, large-scale cases requiring substantial penalties and long-term remedies.
This attack on enforcement is part of a broader effort to weaken the EPA, with the administration also targeting scientific research and protective regulations. Whitehouse described the Zeldin EPA as acting like a subsidiary of powerful industries, particularly oil and chemical companies, and that enforcement is a key part of this industry-friendly agenda.
